In short, a request for production is a formal demand for specific documents, emails, photographs, or records related to a lawsuit. These requests are answered under oath and serve as a formal way to gather evidence before trial. The term originally comes from the discovery process, where both sides exchange evidence to avoid surprises at trial. Essentially, it’s your legal way of saying “Show me the receipts!”

In Texas, requests for production are governed by the Texas Rules of Civil Procedure. For example, you might request contracts, invoices, or text messages that help prove your case. The other party has 30 days to respond, and objections have to be specific. Vague objections such as “too broad” or “burdensome” can be waived if they’re not properly explained.

How Requests for Production Work

Let’s say you’re in a business dispute over unpaid services. As part of the case, your attorney sends the other side a request for production asking for “all communications and payment records between the parties from 2022-2024.” This is your opportunity to obtain emails, texts, contracts, etc. that support your claim.

Because the other side’s responses are formal and legally binding, being precise with your requests is key. If the other party fails to produce the documents requested or only partially complies, the court can enforce further. The court can compel them to turn over the documents or, in some cases, issue the other party sanctions for non-compliance. On the flip side, poorly drafted or overly broad requests can lead to objections and delays.
