Pro hac vice stems from Latin, meaning “for this occasion.” In the legal world, however, it refers to the process by which an attorney licensed in one jurisdiction can appear in court in another jurisdiction where they aren’t licensed. Essentially, it’s your legal way of saying, “I’m just visiting, but I know what I’m doing.” It also allows attorneys to avoid breaking any rules, such as the unauthorized practice of law.
Lawyers are generally required to hold a license in the state where they practice. Practicing without a license is not only unethical, it’s unlawful. However, in today’s interconnected legal world, cases often involve multiple parties, groups, or courts outside an attorney’s home state. That’s where Pro hac vice comes in.
For example, Mickey was admitted pro hac vice in Illinois to prosecute a class action lawsuit against Caterpillar, Inc., even though he’s licensed in Texas. Similarly, Mickey has sponsored several out-of-state attorneys seeking admission to Texas courts for specific cases.
How Does Pro Hac Vice Work?
So, how does the whole process work? How does an attorney get admitted pro hac vice? The process varies by jurisdiction, but generally, three requirements must be met:
- The attorney must be in good standing in their home jurisdiction.
- They must be sponsored by a local attorney, known as “Local Counsel.” This must be someone who is licensed in the jurisdiction where the case is filed.
- They must formally agree to follow the local rules and demonstrate a willingness to learn them.
Once admitted, the visiting attorney can participate in the case just like a local lawyer, for only that specific matter.
